Please read these Terms and Conditions carefully before placing an order. By accessing snowe.is, creating an account, or completing a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Site or place an order.
ALL SALES ARE FINAL. Snowe Inc. does not accept returns and does not issue refunds. Chargebacks and payment disputes initiated against Snowe Inc. will result in immediate account termination and blacklisting of the associated email address and shipping address, as described in Section 9.
1. Who we are
These Terms and Conditions (the “Terms”) govern your access to and use of the website located at https://snowe.is (the “Site”) and any products purchased from Snowe Inc. (“Snowe,” “we,” “us,” or “our”).
Legal entity: Snowe Inc.
Website: https://snowe.is
Contact for orders and these Terms: [email protected]]
These Terms apply together with any order confirmation, checkout disclosures, and our Privacy Policy. If there is a conflict between promotional language on the Site and these Terms, these Terms control.
2. Acceptance of these Terms
You accept these Terms by doing any of the following:
- visiting or using the Site;
- creating an account;
- adding items to your cart or starting checkout;
- placing an order; or
- paying for products.
If you use the Site on behalf of a business, you represent that you have authority to bind that business, and “you” includes that business.
3. Eligibility and accounts
You must be at least the age of majority in your province, territory, or country of residence (18 in most of Canada) and able to form a binding contract. The Site is intended for personal, non-commercial purchases unless we agree otherwise in writing.
You are responsible for providing accurate account, billing, email, and shipping information and for keeping that information current. You are responsible for all activity under your account and for keeping your password confidential.
We may refuse registration, cancel an account, or refuse an order at any time, including where we suspect fraud, chargeback risk, abuse of promotions, or a prior ban or blacklist.
4. Products, pricing, and descriptions
We try to describe products accurately, including colors, sizes, materials, and pricing. Photographs and descriptions are for illustration. Actual products may vary slightly due to lighting, screen settings, manufacturing variation, or packaging.
Prices are displayed in the currency shown at checkout (typically Canadian dollars) and may change at any time before we accept your order. We may correct pricing, tax, or shipping errors even after an order is submitted. If we discover an error after payment, we may cancel the affected item and, if we collected payment for that item and do not ship it, we will reverse that specific charge. That reversal is not a “refund” of a completed sale of shipped goods.
We do not guarantee stock. An item in your cart is not reserved until we accept the order and payment clears.
5. Orders and our acceptance
When you place an order, you make an offer to buy the products on these Terms. An order confirmation email is an acknowledgement that we received your order. It is not our acceptance.
A contract is formed only when we accept the order by charging your payment method and/or dispatching the products. We may refuse or cancel an order for any reason, including suspected fraud, incorrect pricing, stock issues, shipping restrictions, or a banned or blacklisted customer, email, or address.
You are responsible for reviewing your cart before paying. We are not required to change, split, or cancel an order after it is submitted. If you notice an error immediately after checkout, contact us right away. We may, but are not required to, attempt a change if the order has not yet been processed.
6. Payment
You authorize us and our payment processors to charge the payment method you provide for the product total, shipping, taxes, duties (if collected), and any other amounts shown at checkout.
You represent that you are authorized to use that payment method and that the information you provide is true. If a payment is declined, reversed, or later fails, we may cancel the order and/or pursue the unpaid amount.
We may use third-party processors. Their terms apply to the processing of your payment data. We do not store full card numbers on our servers.
7. Shipping, delivery, and risk of loss
We currently offer Canada-wide delivery and may ship to other destinations if shown at checkout. Shipping options, costs, and estimated timeframes are presented at checkout and are estimates only. We are not responsible for carrier delays, customs delays, weather, incorrect addresses, or failed delivery attempts.
You must provide a complete and accurate shipping address that can receive packages. If a package is returned because of an incorrect address, an unclaimed parcel, a refused delivery, or a failed pickup, we are not required to reship or refund. We may, at our sole discretion, offer a reship if you pay any additional shipping and related costs.
Title and risk of loss pass to you when we deliver the products to the carrier. After that point, claims for lost or damaged packages in transit should be directed to us so we can review tracking. Any replacement, reshipment, store credit, or other assistance is at our sole discretion and is not guaranteed.
Import duties, brokerage fees, and taxes for any international shipment (if offered) are your responsibility unless we expressly collect them at checkout.
8. No returns. No refunds. All sales final.
This is a core term of every purchase from Snowe Inc.
Snowe Inc. does not accept returns.
Snowe Inc. does not issue refunds.
All purchases are final sale. This includes, without limitation:
- change of mind or buyer’s remorse;
- ordering the wrong size, color, quantity, or product;
- items that do not meet your personal expectations or preferences;
- gifts;
- sale, clearance, preorder, or promotional items; and
- orders you later decide you cannot afford or no longer want.
We do not provide return labels, prepaid return shipping, exchanges as of right, or cash/credit-card refunds.
8.1 Store credit or coupons (rare and discretionary)
In rare cases, we may offer store credit, a coupon, a replacement, or another commercial gesture. Any such offer:
- is decided solely by Snowe Inc.;
- is not an admission of fault;
- cannot be demanded, expected, or guaranteed;
- may be limited in amount, expiry date, products, or one-time use;
- has no cash value and is not transferable unless we say otherwise; and
- does not change the general rule that we do not accept returns and do not issue refunds.
A prior courtesy to you or to another customer does not create a right to the same treatment again.
8.2 What this policy does not try to take away
Nothing in these Terms is intended to exclude a remedy that applicable law says cannot be excluded. If a law in your province or country requires a particular remedy for a product that is not delivered, is not as described in a legally material way, or is defective, we will comply with that law. Where the law allows us to limit the remedy, our preferred remedy is repair, replacement, or store credit — not a cash refund — unless the law requires otherwise.
If you believe a product was never shipped, the carrier shows it was not delivered, or you received the wrong item, contact us promptly at [INSERT EMAIL] with your order number, photos if relevant, and tracking details. We will investigate. Investigation does not mean a refund will be issued.
9. Chargebacks and payment disputes
Do not file a chargeback or payment dispute as a substitute for contacting us.
By placing an order you agree that:
- you authorized the charge shown at checkout;
- you purchased products on an all-sales-final, no-return, no-refund basis;
- you will contact Snowe Inc. first to raise any issue with an order; and
- initiating a chargeback, card dispute, PayPal/online-wallet dispute, or similar reversal because you changed your mind, because you want a refund we do not offer, or without first giving us a reasonable chance to review the issue, is a material breach of these Terms.
9.1 Consequences of a chargeback or dispute
If you, or anyone using your payment method, initiate a chargeback or payment dispute against Snowe Inc., we may immediately, and without further notice:
- ban your user account;
- cancel any open or future orders;
- blacklist the email address used on the account or order;
- blacklist the shipping address used on the order;
- blacklist related identifiers we reasonably associate with you (for example, billing address, phone number, and account name); and
- refuse future sales to you or to that address.
A ban and blacklist are permanent unless we decide otherwise in writing. Creating a new account, using a different email, or shipping to a slightly altered address to get around a ban is prohibited and may result in cancellation of new orders without shipment.
9.2 We contest improper chargebacks
We will contest chargebacks and payment disputes that we believe are improper, including disputes based on buyer’s remorse, “item not as described” when the listing was accurate, or “item not received” when tracking shows delivery or attempted delivery to the address you provided.
If a chargeback or dispute results in funds being pulled from us after we have shipped products or otherwise performed, the amount remains due and payable by you. We may send the unpaid amount to collections and/or pursue available legal remedies, including our costs of defending the dispute where permitted.
9.3 Friendly fraud and abuse
Using a chargeback to keep both the product and the money is theft of services/goods and may be reported to the payment processor, card network, and appropriate authorities where warranted.
10. Promotions, coupons, and store credit
Promotional codes, coupons, gift cards, and store credit are subject to their stated rules and to these Terms. Unless we say otherwise, they cannot be combined, have no cash value, are non-transferable, may expire, and may be cancelled if we suspect abuse, resale, or fraud.
We may modify or end a promotion at any time. A coupon or store credit issued as a rare courtesy under Section 8.1 does not create a refund right.
11. User conduct and prohibited uses
You agree not to use the Site for any unlawful purpose; provide false identity, payment, or shipping information; circumvent a ban, blacklist, or security measure; scrape or harvest the Site except as allowed by ordinary browser use; interfere with the Site’s operation; post false, defamatory, or unlawful reviews; or resell our products as a business without our written consent.
12. Intellectual property
The Site and all content on it — including the Snowe name, logos, product photos, text, graphics, layout, and software — are owned by Snowe Inc. or its licensors and are protected by intellectual property laws. You may not copy, reproduce, modify, or commercially exploit any part of the Site without our prior written permission.
13. Reviews and user content
If you submit a review, photo, question, or other content, you grant Snowe Inc. a worldwide, royalty-free, perpetual license to use, display, edit, and distribute that content in connection with our business. You represent that your content is accurate, is yours to share, and does not violate anyone’s rights. We may remove content at our discretion.
14. Privacy
We collect and use personal information as described in our Privacy Policy (https://snowe.is/privacy-policy). By using the Site, you consent to that collection and use, including use of order, email, and shipping information to fulfill orders, prevent fraud, and administer bans and blacklists described in these Terms.
15. Electronic communications
You agree to receive electronic communications from us, including order confirmations, shipping updates, and notices about these Terms, at the email address you provide. Legal notices are effective when sent to that email or posted on the Site.
16. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND THE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT FOR ANY WARRANTY THAT CANNOT BE EXCLUDED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that product descriptions are complete in every respect.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNOWE INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF THE SITE OR ANY PURCHASE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TO SNOWE INC. FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability is limited to the greatest extent permitted.
18. Indemnity
You will indemnify and hold harmless Snowe Inc. and its directors, officers, and employees from claims, losses, and reasonable legal fees arising out of your breach of these Terms, your misuse of the Site, your chargeback or payment dispute in breach of Section 9, or your violation of law or third-party rights.
19. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including carrier failure, customs, supply shortages, labour disputes, utilities or internet outages, cyber incidents, fire, flood, pandemic, or government action.
20. Changes to the Site and to these Terms
We may update these Terms at any time by posting a revised version on the Site and updating the “Last updated” date. The version in effect when you place an order governs that order. Continued use of the Site after a change constitutes acceptance of the revised Terms for future use.
21. Governing law and disputes
These Terms and any dispute arising out of the Site or a purchase are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
You agree that the courts of British Columbia, sitting in Vancouver, have exclusive jurisdiction, except that we may seek injunctive or collection relief in any jurisdiction where you reside or where a shipment was sent.
If you are a consumer and mandatory local law gives you the right to bring a claim in your home province or country, that right is not overridden to the extent the law forbids it.
22. General
If a provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms. We may assign ours. These Terms are the entire agreement between you and Snowe Inc. regarding the Site and purchases.
